Legal challenges are expected if Republicans proceed with their plans. Civil rights groups like the American Civil Liberties Union (ACLU) are preparing for battles in court. They argue that DEI programs are crucial for upholding civil rights laws and creating equal opportunities for all Americans. The ACLU's Renika Moore stated, "We are crafting a legal strategy to fight anti-DEI plans that defy civil rights laws. "
At the Department of Justice, Harmeet Dhillon, Trump's pick to lead the Civil Rights Division, is likely to support these moves and may not legally defend targeted DEI programs. Additionally, Congress has proposed the "Dismantle DEI" Act, which aims to cancel all federal DEI programs and related executive orders.
Civil rights and disability advocacy groups warn that eradicating DEI programs could negatively impact settled civil rights laws. Liz King of the Leadership Conference on Civil and Human Rights emphasized, "It is not possible to comply with our civil rights laws without also pursuing diversity, equity, and inclusion. "
