Court Battle Brews Over Birthright Citizenship
Thursday, February 20, 2025
For over a century, the 14th Amendment has granted citizenship to anyone born on U. S. soil, regardless of their parents' immigration status. The Trump administration sought to change this by ending birthright citizenship for children of undocumented immigrants or those on temporary visas. This move was met with strong opposition, particularly from Democratic attorneys general from four states, including Washington.
The attorneys general argued that the dispute was not about immigration but about the constitutional rights to citizenship. They claimed that the president does not have the authority to deny these rights. The court agreed with this perspective, stating that the administration had not proven it would likely win the case.
Judge Danielle Forrest, a Trump appointee, wrote a separate opinion. She did not express a view on the legal arguments but noted that the administration had not shown an emergency requiring immediate court intervention. She emphasized that deciding such important issues on short notice was not ideal.
The court's decision has set the stage for a potential Supreme Court showdown. This case highlights the ongoing debate over immigration and citizenship rights in the United States.
