Fit or Not: How Mental Health Affects Court Trials in India

Only slightly more than half, 54. 7 %, were deemed fit to stand trial. The biggest reasons for being found unfit were active psychiatric symptoms and conditions that hurt thinking or memory, such as organic brain disorders or intellectual disability. Statistical analysis showed these factors increased the odds of unfitness by more than 20 times.
The findings underline the importance of proper tools and programs to assess and help defendants, especially under India’s latest law on citizen protection. They also suggest that courts need to consider mental health carefully when deciding whether a person can participate in their own trial.
