Illinois Groups Fight Against Abortion Coverage Law

Several groups and companies that disagree with abortion have filed a lawsuit against Illinois Governor JB Pritzker. They aim to stop the enforcement of a law that makes health insurers cover abortions and abortion pills without extra costs to patients. The lawsuit, filed in a federal court, targets rules that require state-regulated insurers to cover these services. The groups argue that these laws force them to buy health plans that include abortion coverage, even if they oppose it. This includes organizations like Students for Life of America and the Pro-Life Action League, as well as some Illinois residents. They say there are no exceptions for people who object to abortion on moral or religious grounds. Alex Gough, a spokesperson for the governor, said the lawsuit is extreme and could put women's safety at risk. Attorney General Kwame Raoul expressed support for abortion as healthcare, noting that lack of access has led to medical emergencies. The Department of Insurance didn't immediately comment. The laws only apply to state-regulated plans, and many large employers offer self-funded insurance that isn't covered by these rules. However, most of the groups suing say they're too small to offer such plans. In the past, similar lawsuits have been dismissed. For instance, a judge threw out a case by the Illinois Baptist State Association, saying they could buy non-state-regulated plans without abortion coverage. Illinois has been strengthening abortion access laws. In 2019, Governor Pritzker signed a law making abortion a fundamental right. In 2023, he signed another law protecting providers and allowing more types of providers to offer abortion care.
