Media Titans Disney, Warner, Fox Sue for Swift Appeal of Stalled Sports Streamer

Despite the setback, Disney, Warner, and Fox remain optimistic and are seeking an expedited appeal to allow for a potential debut during the college and NFL playoff games, including the College Football Playoff National Championship and the Super Bowl. The media giants argue that their licenses with Venu are non-exclusive and that the cost of the service is lower than that of larger cable and satellite distributors.
Each company is contributing one-third of Venu's start-up costs and has the ability to launch other services that offer their sports programming. Warner, for instance, has added a sports tier to its Max streaming service, while ESPN is working on a stand-alone direct-to-consumer service called Flagship.
The three media companies have proposed an appeal schedule with oral arguments set for December
