Menendez Brothers' Resentencing Pushed to January

A judge has postponed his decision on resentencing Erik and Lyle Menendez until January. He cited the need to review 17 boxes of documents and give the new district attorney time to weigh in. This delay dashed the family's hopes of having the brothers home for the holidays. The hearing was intended to be the first court appearance for the brothers in decades. However, technical issues prevented them from appearing virtually from prison. The Menendez brothers were convicted in 1989 for murdering their parents and were sentenced to life without parole. Their lawyers now argue there is new evidence of sexual abuse by their father. The judge agreed to let two elderly aunts testify about the brothers' abuse and argue for their release. One aunt, turning 93, and the other, 85, shared emotional testimony. They said 35 years in prison was enough, considering the abuse the brothers had suffered. Despite technical problems, the hearing lasted less than an hour.

The Menendez case regained attention recently with the release of Netflix's "Monsters: Lyle and Erik Menendez Story" and a 2024 documentary. Some family members hope the brothers could be freed, given today's societal awareness of sexual abuse. However, not all family members support resentencing. New evidence includes a letter from Erik Menendez describing the abuse and the declaration by a former Menudo member who claimed abuse by their father. This new evidence, if presented during the trial, might have changed the outcome, according to the petition. Governor Gavin Newsom will wait for the new district attorney's review before making a decision.
