The lawsuit, obtained by Rolling Stone, highlights the similarities between the two songs, including the melodic pitch design, bass-line, and specific chord progressions. Tempo Music claims that "Flowers" would not have existed without "When I Was Your Man" and that Miley Cyrus, along with songwriters Gregory Hein and Michael Pollack, have created a derivative work without authorization.
The company is seeking to bar Miley from distributing, reproducing, and publicly performing the song, as well as requesting damages. The amount of damages is currently unknown. "Flowers" earned Miley a record of the year and best pop solo performance at the 2024 Grammys, but the lawsuit may put a damper on her celebrations.
It remains to be seen how Miley and her team will respond to the lawsuit, but for now, the singer is keeping mum on the matter.
