However, Philadelphia District Attorney Larry Krasner argued that the PAC's activities were a "scam" and an "illegal lottery. Chris Young, the PAC's treasurer, testified that recipients were questioned before winning to ensure their values matched those of the PAC. He also admitted that the term "randomly" used by Musk was not accurate. Chris Gober, the PAC's former treasurer, confirmed that the $1 million recipients were not chosen by chance.

The judge's decision did not end the district attorney's lawsuit, which alleges violations of Pennsylvania lottery and consumer protection laws. Krasner believes his case has become stronger due to the PAC's admissions about the selection process.
