Philadelphia’s Smoke Shops: A Battle Over Kratom, Safety, and the City’s Future

The City of Brotherly Love is at the center of a heated debate over the future of smoke shops selling unregulated substances like kratom and hemp-based THC. Two new bills could drastically reshape the industry—classifying these products as "intoxicating," mandating special licenses, and enforcing mandatory safety testing. A 21-and-over purchase age is also on the table.

The urgency? Years of complaints about crime-linked smoke shops, blighted neighborhoods, and easy access to untested—and potentially dangerous—products.

The Controversy Over Kratom: Miracle Plant or Hidden Danger?

At the heart of the storm is kratom, a Southeast Asian plant with dual effects. In small doses, it acts as a mild stimulant. In larger amounts, it serves as a painkiller—but highly concentrated extracts like 7-OH kratom are raising alarms.

These extracts target opioid receptors in the brain, increasing the risk of addiction and severe withdrawal. Dr. Bella Kalayilparampil of the University of Pennsylvania has treated patients who began with natural kratom but eventually became dependent on stronger versions.

One former user, Danny Rosenberg, described his withdrawal as worse than OxyContin, leaving him in agony for weeks.

Regulate or Ban? The Divide Among Experts

While some push for stricter oversight, others question whether kratom is truly the public health threat opponents claim.

Dr. Ed Boyer, who testified on the issue, admitted receiving far fewer reports of kratom addiction than the opioid crisis in neighborhoods like Kensington. Yet his testimony was funded by a law firm representing kratom companies, sparking conflict-of-interest concerns.

Kratom sellers are fighting back, arguing the proposed rules could ban even natural leaf kratom by treating it like a prescription drug. Allison Smith of the Global Kratom Coalition warns against a full ban, urging a balanced regulatory approach.

A System Riddled with Loopholes

Despite past attempts to crack down, enforcement remains inconsistent. Landlords and store owners exploit legal gaps, shutting down one shop only to see it reopen under a new name.

For residents, the consequences are real:

• Children pass smoke shops daily on their way to school.
• Seniors feel unsafe at night due to aggressive crowds.
• Contaminated products—like hemp edibles laced with mold and pesticides—pose hidden risks.
