Snack Freedom Wins Legal Battle

A federal judge in Washington, D. C. has stopped the Trump administration from blocking people who use food stamps from buying sugary drinks and candy in five states. Judge Amy Berman Jackson said the Department of Agriculture (USDA) does not have the legal power to approve state rules that would prevent Supplemental Nutrition Assistance Program (SNAP) users from buying soda or candy. The decision was based on a lawsuit filed by residents in Colorado, Iowa, Nebraska, Tennessee and West Virginia. They argued that the restrictions would cut off essential foods they need for health reasons or to keep up with daily life. The USDA had allowed 23 states to request “food restriction” waivers that would let them stop SNAP participants from purchasing certain items. These moves were part of a campaign called “Make America Healthy Again, ” promoted by Agriculture Secretary Brooke Rollins and Health and Human Services Secretary Robert F. Kennedy Jr.
The judge noted that while states can try to encourage healthier choices, they cannot violate federal law or existing regulations. In a statement after the ruling, an USDA spokesperson said the agency would keep pushing for limits on junk food purchases with SNAP money. The judge, however, clarified that USDA waivers can only cover limited purposes such as improving program efficiency, not health improvement. The court’s order is seen by supporters as a win for millions of families who rely on SNAP. It restores the ability to buy food items that some consider necessary for managing conditions like diabetes or allergies.
