Tree Battle in Stanley Park: Who’s Right?

In Vancouver’s beloved Stanley Park, a group of park users has taken their fight against tree removal to court. They claim that the city and park board are negligent for ordering the cutting down of thousands of trees due to a looper moth infestation. The plaintiffs, Michael and Katherine Caditz, Anita Hansen, and Jillian Maguire, believe this action is based on flawed science and has caused them emotional harm. The B.C. Supreme Court recently ruled against their request for an injunction to stop the tree removal. The court noted that the case raised novel issues about the duty of care owed by the city and park board to park users. However, it concluded that a trial was unlikely to establish such a duty. Despite this setback, the plaintiffs are exploring other legal options.

Michael Caditz expressed his disagreement with the court’s ruling, stating that they still believe the tree removal is based on bad science. He mentioned consulting experts who agreed that the logging operation wasn't necessary and could increase risks like falling trees and fires. The court did acknowledge time for further consideration and noted potential legal challenges if future tree removals go beyond planned limits.
